Parenting matters are governed by the Family Law Act 1975, which places the best interests of the child at the centre of every decision. Arrangements can be recorded informally through a parenting plan, or made legally binding through parenting orders.
A parenting plan is a written, signed and dated agreement between parents. It is flexible and easy to change by agreement, but it is not enforceable in the same way as a court order.
Parenting orders are made by the Court and are legally binding. They can be made by consent where parents agree, or decided by the Court where they cannot.
